Terms of Service

1. Agreement to Terms

By accessing and using EPSee ("the Service"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

EPSee is operated by EPSee Limited ("we", "us", or "our"). The Service provides EPC compliance monitoring and management tools for UK property landlords and managers.

2. Service Description

EPSee provides:

• Automated EPC certificate tracking and expiry monitoring
• Alerts for upcoming EPC renewals (90/60/30 days before expiry)
• Legislative change notifications affecting your properties
• Portfolio compliance dashboard and reporting
• Integration with the UK Government EPC Register

Important: EPSee is a monitoring and alerting tool. We do not conduct EPC assessments, issue EPC certificates, or provide legal/regulatory advice.

3. Account Registration

3.1 Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use EPSee. By registering, you represent that you meet these requirements.

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

3.3 Accurate Information

You agree to provide accurate, current, and complete information during registration and to update it as necessary to maintain accuracy.

4. Subscription Plans and Billing

4.1 Free Plan

• Available for up to 5 properties
• Includes all core features
• No credit card required
• Free forever (subject to fair use policy)

4.2 Paid Plans

• Standard: £49/month for 6-50 properties
• Professional: £99/month for 51-150 properties
• Agency: £149/month for 151+ properties

4.3 Billing Terms

• Subscriptions are billed monthly in advance
• Payment is processed securely through Stripe
• Prices are in £ and exclude VAT (added at checkout)
• You authorize us to charge your payment method automatically each billing cycle
• Failed payments may result in service suspension after grace period

4.4 Plan Changes

• You may upgrade at any time (prorated credit applied)
• Downgrades take effect at the start of the next billing cycle
• Downgrading to Free plan requires reducing properties to 5 or fewer

5. Cancellation and Refunds

5.1 Cancellation

• You may cancel your subscription at any time
• Access continues until the end of your current billing period
• No partial refunds for unused time
• You may reactivate at any time

5.2 Refund Policy

• Refunds are provided within 14 days of initial purchase only
• After 14 days, no refunds for monthly subscriptions
• Refunds processed to original payment method within 5-10 business days

6. Acceptable Use

You agree NOT to:

• Violate any laws or regulations
• Infringe intellectual property rights
• Upload malicious code or viruses
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Use the Service for any illegal or unauthorized purpose
• Scrape, harvest, or collect data from the Service
• Share your account credentials with others
• Resell or redistribute the Service without permission

7. Data and Privacy

Our collection and use of your personal information is governed by our Privacy Policy. By using EPSee, you consent to such processing and warrant that all data you provide is accurate.

7.1 EPC Data

We retrieve EPC certificate data from the UK Government EPC Register. This is public data, and we make no representations about its accuracy or completeness.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by EPSee and are protected by UK and international copyright, trademark, and other intellectual property laws.

You retain ownership of any property data you input. By using the Service, you grant us a license to use this data to provide and improve the Service.

9. Disclaimers and Limitations

9.1 No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

9.2 Not Legal Advice

EPSee provides monitoring tools only. We do not provide legal, regulatory, or professional advice. You remain solely responsible for ensuring your properties comply with all applicable laws and regulations.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EPSee SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless EPSee and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any data you submit to the Service

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, if you breach these Terms or engage in conduct that we deem harmful to the Service or other users.

Upon termination, your right to use the Service ceases immediately. We may delete your data in accordance with our Privacy Policy.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through a prominent notice on the Service.

Continued use of EPSee after changes constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
